Felonies and misdemeanors are often classified in one of three broad categories: violent,

property, and drug-related.  Violent crime refers to events such as homicide, rape, robbery and assault that result in an injury to a person.   Homicides may be prosecuted as either murder or manslaughter, the former carrying the severest penalties.

Manslaughter is the unlawful killing of a human being without malice.  There are 3 types of manslaughter: voluntary, involuntary, and vehicular.

Murder charges (first and second degree) allege the intentional  killing of another with malice (which can be hatred or merely disregard of his/her life).   First degree murder is the most serious.  There are two ways that a murder can be deemed “first degree” under California Penal Code Section 189: either because it displays “premeditation” OR because it was committed in the perpetration, or attempt to perpetrate, certain felonies.  This latter category constitutes what is known as the “Felony Murder Doctrine” and its implications are very broad.  A typical example is a robbery involving more than one criminal, in which one of them kills someone.  Even if the death were accidental, all of the participants could be found guilty of felony murder, including those who did no harm, had no weapon, and/or did not intend to hurt anyone. Furthermore, if one of the co-conspirators is killed, his/her fellow robbers can be charged with murder.
