Sonoma County - Motion to Vacate Conviction/Sentence Granted

March 2025

Our client in Sonoma County had two misdemeanor violations of Penal Code Section 484(a) - (Petty Theft), along with a number of other prior convictions.  Client was never informed by his prior attorney of the full potential immigration consequences in the theft cases and was now facing deportation and/or denial of Naturalization as of result of these prior convictions.  Another attorney filed a Motion to Vacate Conviction/Sentence pursuant to Penal Code section 1473.7(a)(1) but it was denied. We took on the case, performed an extensive investigation and filed an air-tight Second Motion to Vacate Conviction/Sentence pursuant to Penal Code section 1473.7(a)(1). The court then GRANTED our Motion to Vacate and our client is safe to continue to reside in the US without fear of deportation.
