Alameda County Client- Arrested for Child Porn sentenced to Only Probation

Our Alameda County client was arrested in the Oakland area for a felony violation of Penal Code Section 311.2(c) – (Distributing of Child Pornography) and a violation of Penal Code Section 311.11(a) – (Possession of Child Pornography). After a thorough computer forensics investigation and the presentation of a strong mitigation case as well as aggressive negotiations with the Alameda County District Attorney's Office, where we emphasized weakness in the prosecutor's evidence, we convinced the District Attorney's office to resolve the case with an offense that did not require Penal Code Section 290 sex offender registration. Furthermore, our client was sentenced to only probation with no jail time and the District Attorney's office agreed to not object to a reduction of the charge to a misdemeanor if our client complies with the terms of probation.
